Question 39
A person owns three houses: one in which he lives, one in which his brothers live, and a third in which his brothers live together with his mother—the owner’s mother. On which of them is khums due?
Ahmed al-Hasan Response:
There is no khums on the house in which he lives. Khums is due on the house in which his brothers live, and khums is also due on the third house in which his brothers and his mother live. Since maintenance of the mother is obligatory upon him, he may deduct from the khums an amount equal to one year’s rent for his mother. He may also pay the khums in installments.
