Question 35

Must inheritance be subject to khums, whether at the time it is received or after the end of the recipient’s khums year? And is there a difference between an expected inheritance and an unexpected inheritance, as is commonly discussed?

Ahmed al-Hasan Response:

If the inherited wealth is wealth on which khums was already paid, khums is not paid on it again. But if the deceased did not pay khums on his wealth, then the recipient pays khums on it when he receives it.
