Question 175

A man had a mistress with whom he sought enjoyment without a marriage contract. He then contracted a temporary marriage with her, and afterward married her in a permanent marriage. What is the ruling concerning this?

Ahmed al-Hasan Response:

In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, Lord of the worlds. If he had intercourse with her through fornication-that is, before the contract-while she had a husband or was observing a waiting period, she became prohibited to the fornicator after her divorce or the completion of her waiting period. But if she had neither a husband nor a waiting period, it is permissible for him to marry her. Sayyid Ahmed Alhasan Vicegerent and Messenger of Imam al-Mahdi (a)
