Question 151

In transactions between people, such as selling cars, houses, or animals, disputes may arise because one party failed in some matter. May the parties refer to prevailing custom, specialists in such transactions, or tribal authorities to resolve the dispute?

Ahmed al-Hasan Response:

There is no problem with referring to prevailing custom, specialists, or tribes as long as they bring about mutual satisfaction between the two parties.
