Question 46

Is imported fish from non-Muslim countries considered ritually lawful? May it be used as feed for domestic animals? And may it be eaten when we do not know whether it has scales or smooth skin?

Ahmed al-Hasan Response:

If you know that it has scales and are reassured that it was properly taken, it may be eaten. The ritual taking of fish consists of taking it alive from the water or catching it with fishing equipment, whether the person taking or catching it is Muslim or non-Muslim. Imported fish is ordinarily caught by nets and fishing equipment, removed from the water, and left to die outside the water, so it is considered properly taken even if the fisherman is not Muslim. Fish that is not considered properly taken is fish that dies in the water without having become caught in fishing equipment, or fish that a person deliberately causes to die in the water—for example, by leaving it in a small pool until it dies—or fish caught in fishing equipment that is deliberately left in the water until it dies there.
