Question 88
I am the son of the martyr Shaykh Mahdi al-Samawi, who was arrested by the unbelieving Saddam regime together with the martyr Sayyid Muhammad Baqir al-Sadr, may God have mercy on him. His body was never handed over to us. We received information through good people that his remains are in al-Hudayri Cemetery in Samawah. I do not know my legal duty, especially because the burial was not performed properly and we are not certain that the remains are actually his; it is only something that has been said.
Ahmed al-Hasan Response:
If it is merely a statement with no basis for reliance, it should be left aside. If, however, it is testimony in which one can reasonably have confidence, the place may be regarded as his grave, may God have mercy on him, and he may be visited there. If you wish to confirm that the remains are his, the grave may be opened and a sample taken for DNA testing. If the grave is opened for verification and the identity is confirmed, you may then move the remains and bury them properly. The Bayt al-Mal may bear the cost of the DNA test if you are unable to do so.
