Question 131
I built a house on state-owned land that belongs to no individual. It does not affect a market, school, or street, and I obtained the neighbors’ approval before building. What is the ruling concerning this house? Peace be upon you.
Ahmed al-Hasan Response:
In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, Lord of the worlds, and may Allah send prayers upon Muhammad and the family of Muhammad, the Imams and the Mahdis, and grant them abundant peace. The land belongs either to Imam al-Mahdi (a) or to the Muslims who believe in the truth, and the Imam has the right to dispose of it. The state of the false deity has no religious right to dispose of it. Every believer in the truth who does not own a house in which to live therefore has the right to live upon it and build a house for himself. No regard is given to the state of the false deity or the foolish people loyal to it, who regard land that Saddam or tyrants like him assigned to them as legitimate, while regarding land in which the Imam permits his guardians to act as illegitimate! ([277]).

↑ [277] Umar ibn Yazid said: I saw Mismā in Medina. That year he had carried money to Abu Abdullah (a), but Abu Abdullah returned it. I asked him, ‘Why did Abu Abdullah return the money you carried to him?’ He replied: ‘When I carried the money to him, I said: “I had been placed in charge of pearl-diving in Bahrain and obtained four hundred thousand dirhams. I have brought you its khums, eighty thousand dirhams. I disliked withholding it from you or exposing it to anything, for it is your right that Allah, Blessed and Exalted, placed in our wealth.” He said: “Is only the khums ours from the land and what Allah brings forth from it, O Abu Sayyar? Indeed, all the earth belongs to us, and whatever Allah brings forth from it belongs to us.” I said to him, “Then I will carry all the money to you.” He said: “O Abu Sayyar, we have made it wholesome for you and made you free to use it, so join your wealth to yourself. Everything of the earth that is in the hands of our Shia has been made lawful for them until our Qa’im rises. He will collect from them the land tax for what is in their hands and leave the land in their hands. As for what is in the hands of others, their earnings from the land are prohibited to them until our Qa’im rises, takes the land from their hands, and expels them in humiliation.”’ Umar ibn Yazid said: Abu Sayyar told me, ‘I do not see anyone among the owners of estates or those who administer works consuming what is lawful except me, unless it has been made wholesome for them.’ Al-Kafi, vol. 1, p. 408. There are many narrations with this meaning that I have left unmentioned because prolonging the discussion would not suit this context. (Commentator.)
