Question 269

In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, Lord of the worlds, and may Allah send prayers upon Muhammad and the family, the Imams and the Mahdis, and grant them abundant peace. Question: Concerning financial loans from foreign, non-Muslim banks here in Europe: some Muslims take a monetary loan from a bank to buy a home and then repay the sum with interest at a rate of 6.84 percent over 20, 25, or 30 years. It is possible to pay only the interest while the principal remains owed by the person until he sells the home and repays the loan from the proceeds; or, in another case, he repays part of the loan monthly plus the required monthly interest of 6.84 percent. The total monthly amount paid by the person is therefore rent, loan repayment, and interest. My master and guardian Ahmed Alhasan, is taking a loan from the bank and repaying it to the bank with monthly interest lawful or unlawful? What you declare lawful is what Muhammad declared lawful, and what you declare unlawful is what Muhammad declared unlawful. Thanks be to Allah, Owner of sovereignty, who causes the sphere to move and is Judge of Judgment, for granting me success and faith in you. I ask Allah to make me one of your soldiers, obedient to your commands, and martyred at your hands. Your obedient servant, Layth. Sender: Layth - Malmö, Sweden

Ahmed al-Hasan Response:

In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, Lord of the worlds, and may Allah send prayers upon Muhammad and the family of Muhammad, the Imams and the Mahdis, and grant them abundant peace. A loan with interest is forbidden usury, but forbidden usury is realized between one believer and another believer, or between a believer and a Muslim who does not set himself in enmity against the Imams and the Mahdis (a). Your question concerns whether taking a loan from a bank and repaying it to the bank with monthly interest is lawful or unlawful. Its answer depends upon the bank’s identity-that is, the owner or owners of the bank. If they are neither believers nor Muslims who profess affection for the family of Muhammad (a), it is permissible to take the loan even if it bears interest. It is likewise permissible to lend to them or deposit money with them and receive interest from them. Praise be to Allah, Lord of the worlds. Ahmed Alhasan
