Question 700
In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, Lord of the worlds. O Allah, send prayers upon Muhammad and the family of Muhammad, the Imams and the Mahdis, and grant them peace. Peace, mercy, and blessings of Allah be upon you. A sister in Iran stipulated in her marriage contract that she could receive her dowry whenever she demanded it. Now, several years after her marriage, she has demanded her dowry from her husband because of certain matters. Since her husband cannot pay the dowry in cash, under Iranian law the court orders the seizure of his property so that the wife’s dowry can be paid from that property or money. If the husband has no money or property except his share of an inheritance, the Iranian court orders the seizure and detention of his share of the inheritance and its sale, even without the consent of the remaining heirs-for example, the mother and siblings who have shares in the inheritance to be sold, of which the man owns a share. If the other heirs object and do not consent to selling the inheritance, the Iranian court compels them to pay the man’s share and gives the wife her dowry from it. The question now is: Is this matter religiously permissible? That is, with all these conditions that lead to the other heirs being dissatisfied and distressed, may the court give the woman her dowry in this manner? May Allah reward you with the best reward. Maryam - Iran
Ahmed al-Hasan Response:
In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, Lord of the worlds, and may Allah send prayers upon Muhammad and the family of Muhammad, the Imams and the Mahdis, and grant them peace. It is permissible, but it is more appropriate that there be beneficence between the spouses and that his wife, if he is in hardship, be patient with him until Allah provides for him.
