Question 709

In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, Lord of the worlds, and may Allah send prayers upon Muhammad and the family of Muhammad, the Imams and the Mahdis, and grant them peace. Peace be upon my master, guardian, and Imam Ahmed Alhasan (a). My master, is it permissible to take an amount of money from members of the Baath Party and agents of the former regime because of reports they wrote against people, causing some to be executed, others to be imprisoned, and some to be displaced and have their homes demolished and burned? What is the amount specified for this? Is the harm established by the existence of a report written by a security officer or party comrade? If there is no report, is one witness sufficient? Ahmed al-Hasan Response:

In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, Lord of the worlds, and may Allah send prayers upon Muhammad and the family of Muhammad, the Imams and the Mahdis, and grant them peace. Everyone who has suffered or suffers financial, psychological, or family harm because of another person or a group has the right to demand appropriate compensation, financial or otherwise, within the limits of religious law. As for establishing that the harm occurred, this is referred to the authority before which the dispute is adjudicated, whether tribal or governmental. Our answer neither advances nor delays this matter, because we do not govern or supervise the government of a state in which rights are upheld, such that a question like this would be directed to us.
