Question 714

In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, Lord of the worlds, and may Allah send prayers upon Muhammad and the family of Muhammad, the Imams and the Mahdis, and grant them peace. Peace be upon my master, guardian, and Imam Ahmed Alhasan (a). Some fishers set their nets in the afternoon and go to them the following morning, finding some fish dead in them. Your answer, my master, was that the fisher may take them so long as he did not do so deliberately. What is meant by deliberately? What if the fisher was late and did not go to his nets the following morning-once deliberately, but not for the purpose of the fish dying in the net, and another time because a circumstance caused him to be late? Ahmed al-Hasan Response:

In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, Lord of the worlds, and may Allah send prayers upon Muhammad and the family of Muhammad, the Imams and the Mahdis, and grant them peace. If he sets a net or fishing implement and a fish is brought out in it, it is lawfully taken whether it is brought out alive or dead. Deliberateness means that he deliberately leaves a fish he caught trapped in the fishing implement until it dies in the water-that is, he deliberately causes the fish to die in the water. But if he is late in drawing up the fishing implement and the fish is brought out dead, there is no problem with its being lawfully taken because it became trapped in the fishing implement, even though it died in the water.
