In the name of Allah, the Most Gracious, the Most Merciful. O Allah, send prayers upon Muhammad and the family of Muhammad, the Imams and the Mahdis, and grant them peace. Peace, mercy, and blessings of Allah be upon the remnant of the family of Muhammad. My master, O son of the Messenger of Allah, I am ashamed to send this question because I know that your circumstances and what you are undergoing are extremely difficult. I ask Allah to perpetuate your presence and make us a protection for you, O son of the Messenger of Allah. I implore you not to forget me in the blessing of your supplications. You are likewise in hardship, but what we undergo sometimes distracts us from keeping pace with the journey with you, my guardian. By the right of your pure mother, bestow upon us a glance of satisfaction, O son of the purified ones. As for the question, I hope the brother supporters can spare you by answering me, for they are goodness and blessing. It concerns a house inherited from my father-may Allah have mercy upon him-and I am my father’s executor. We are five brothers and one sister. My eldest brother died during my father’s lifetime-may Allah have mercy upon them-and my mother likewise died approximately two years after my father. How is the inheritance distributed? Does my mother have a share of the inheritance? Does my brother who died during my father’s lifetime have his children inherit together with their paternal uncles? How is my father’s one-third spent, and where? Is it paid to the Yamani Imam to be at his disposal, given that my father and mother died before this blessed call? I supplicate to Allah that, through His grace and generosity, He establish you in the near future and make us a sacrifice and protection for you, O son of the purified ones. In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, Lord of the worlds, and may Allah send prayers upon Muhammad and the family of Muhammad, the Imams and the Mahdis, and grant them peace. I ask Allah to grant you success in every good, direct your steps aright, and make relief and a way out for you in your affair. Regarding your brother who died during your father’s lifetime, he does not inherit from his father. Your mother inherits from her husband-your father-but since she too has died, what she inherits is divided among her heirs. It appears from your words that at her death she had no father, mother, or children other than you to share with her sons and daughter. Therefore, the house is divided among the four living sons and the daughter if there is no debt or matter that must be paid on behalf of the father or mother. In general, it is better for you to act dutifully toward your father and mother, to take out one-third of the house or one-third of its price, and for you, as executor, to place it where you consider appropriate, such as feeding or sheltering orphans, widows, or the poor. May Allah direct your steps aright. As for your shares of the house, or what remains of it after taking out the one-third, they are as follows: The house or its price is divided into nine shares. Each of the four sons receives two of the nine shares, and the daughter receives one. May Allah grant you success, direct your steps aright, and facilitate your affairs toward what contains the good of your Hereafter and this world. Peace, mercy, and blessings of Allah be upon you.
