Question 96

The person with the greatest claim over the deceased is the one with the greatest claim to the inheritance. Does this follow the classes of inheritance, so that when a son and father exist they take precedence over a brother or uncle? And if the deceased leaves a daughter and a brother, who has precedence?

Ahmed al-Hasan Response:

The person with the greater right to inherit has the greater right over the deceased, and the daughter has precedence over the brother.
