Question 158

A person volunteered to drive someone to work, but they had an accident on the way and the passenger died. Tribal custom may hold the driver responsible and require him to pay the deceased's family. Is that correct, or is nothing due from him because he was helping voluntarily?

Ahmed al-Hasan Response:

Nothing is required of the driver unless his negligence is proven, such as exceeding the speed limit prescribed for the road.
