Question 127

What does the ruling of shubhah mean? Is the child considered illegitimate or not, and how is the matter clarified? Should I tell the girl the truth when she grows up, and also tell my own children and the children's uncles? What is my duty toward the girl?

Ahmed al-Hasan Response:

A child of shubhah is attributed to his or her parents and is not an illegitimate child—may God grant you success. In the case described, the owner of the semen is the girl's father and the owner of the egg is her mother. She inherits from them and they inherit from her. The girl must be informed when she becomes capable of understanding these matters, for this cannot be avoided—may God grant you success. There is another important matter: the sons of her mother, the owner of the egg, are her brothers through her mother, and the sons of her father, the owner of the semen, are her brothers through her father. Your duty toward her is the duty of a father toward his daughter.
