Question 126
A believer in the Call donated his sperm to his infertile brother. The sperm fertilized the brother's wife's egg and she gave birth to a girl. He did this out of sympathy so that his brother and his wife would not separate, but he was uneasy about whether it was lawful. This happened three years ago. His brother has since been treated and his wife has become pregnant from her own husband's sperm. What is the religious ruling, how should the donor deal with the girl, and what is the girl's status? The donor also has children, including a son.
Ahmed al-Hasan Response:
The religious ruling is that this act is not permissible: a woman may not become pregnant from the semen of a man other than her husband. As for the girl who was born as a result of what you did in ignorance and without knowing the ruling, her case is treated as one of mistaken intercourse or doubtful attribution. She is attributed to the owner of the semen, who is her father, and his children are her siblings. Her mother is the woman who carried her, and the children of the woman who carried her are also her siblings.
