Question 43
If a person liable for religious dues, such as khums, or indebted to other people is offered an amount of money sufficient for Hajj, may he perform Hajj with it, and will it count as the Hajj of Islam? Or must he first discharge the rights and debts he owes and not go for Hajj?
Ahmed al-Hasan Response:
If he is reassured that he will be able to repay the debt in the future, he may use the money to perform the rites of Hajj, and his Hajj is valid. If he does not have such reassurance, it is preferable that he repay the debt from the money made available to him, and it is disliked for him to leave the debt unpaid. But if he knows with certainty that he will be unable to repay the debt in the future, then he must repay the debt when the ability to do so becomes available.
