Question 343
1) Must the two witnesses who sight the new moon for others be two men, or are one man and two women, two women only, or four women permissible? 2) When does observation and sighting for the month of Ramadan begin: during the day, at dawn, after midday, before it, when twilight appears, after it, before it, or at some other time? 3) Are the following among the conditions for a believing observer of the new moon: puberty, sound eyesight ([96]), uprightness, the witnesses being in the same place and time, direct observation ([97]), certainty and assurance regarding the sighting, and expertise in identification ([98])? 4) What is meant by ‘nor by the moon’s setting after twilight’? Is what is meant the western twilight? Is twilight the same as what is called the western redness at sunset that appears on the western horizon, or is there a difference? 5) What is meant by ‘nor by its being seen on the thirtieth day before midday’? Sender: Sheikh Jihad al-Asadi
Ahmed al-Hasan Response:
In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, Lord of the worlds, and may Allah send prayers upon Muhammad and the family of Muhammad, the Imams and the Mahdis. Answer 1: I mentioned in The Laws that women’s testimony is accepted, so one man and two women is valid. Answer 2: Observation and sighting begin after midday on the twenty-ninth day of the preceding month (for Ramadan, this is the month of Shaban), and observation continues until midnight. The crescent is ordinarily seen after sunset and before twilight disappears. Answer 3: The conditions include puberty, reason, and uprightness. Answer 4: It means the western redness. What is meant is that the crescent is not counted for a previous day merely because it remained in the sky until after the western redness disappeared. Answer 5: It means that if the crescent is seen on the thirtieth day before midday, that day is not counted as the first day of the following month. Ahmed Alhasan
