Question 561
Peace, mercy, and blessings of Allah be upon you. Your Eminence, Sayyid Ahmed Alhasan, I sent an earlier message, but I believe it was not clear. My matter is that I know a girl who was sexually molested when she was twelve years old. The molestation was by her maternal uncle and did not go beyond minor touching. The family learned what had happened, and the girl’s father decided to prevent her from seeing her maternal uncle or even being present in the place where he was, without seeing him, even if she were accompanied by her mother, family, and relatives. He even prevented the children from being present in the place where the maternal uncle was, even if the uncle did not see them. Is he entitled to do that? He believes that the only solution he would accept is killing or burning the uncle. The girl’s maternal uncle has apologized, asked forgiveness, and said that he repented sincerely, but the girl’s father is not convinced of his repentance and still wants to kill him. The girl is now twenty-one years old and has decided to make Allah, Glorious and Exalted is He, the judge between her and her maternal uncle. She does not want any person, whether her parents or family, to intervene. Is this one of her rights? This decision was based upon seeking refuge in Allah through supplication and prayer, until the girl found reassurance in a dream she saw, but she made a promise to herself and to Allah not to tell this dream to anyone at all. She wants only Allah to be the judge between them. Is this her right? Is it permissible to kill the maternal uncle? The maternal uncle has declared his repentance and was afterward granted success in performing the umrah and visiting Imam al-Husayn (a) and other holy places. Your Eminence, Sayyid Ahmed Alhasan, I ask to receive an answer as soon as possible and for the answer to address all the details of the questions mentioned. Thank you. The second matter: I would like to ask whether a wife must obey her husband in everything, without his consulting her or giving her any convincing reason, when she is unconvinced and dissatisfied while the husband refuses to hear her opinion. Another question: At what age may a girl make her own decisions while observing the conditions of the religion? I am sorry for going on at length, and I need a prompt response. Thank you. Peace, mercy, and blessings of Allah be upon you. Sender: M. M.
Ahmed al-Hasan Response:
In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, Lord of the worlds, and may Allah send prayers upon Muhammad and the family of Muhammad, the Imams and the Mahdis, and grant them peace. The father is entitled to prevent this person from approaching his family after it became clear to him that the person had committed this satanic act, but the father is not entitled to kill him. If this person has truly and sincerely repented, Allah accepts his repentance, and Allah is Forgiving, Merciful. But the father retains the right to prevent him from being alone with his daughters or sons. May Allah grant you success and make your steps firm. You can read The Laws of Islam, in which I explained what is obligatory upon a wife toward her husband, and also when a girl has the right of guardianship over herself. The book is published on the website of the Supporters of Imam al-Mahdi (a). If anything remains unclear to you after reading it, you can ask, and I will be at your service, Allah willing. May Allah grant you success and make your steps firm. Peace, mercy, and blessings of Allah be upon you. Ahmed Alhasan Muharram al-Haram / 1432 AH
