Question 560
I was a government employee under the former regime. At that time, I took possession of a sum from the department because I needed it. Is it permissible for me to give charity on its behalf and pay khums on the remaining sum so that I can use it for personal matters? Sender: The Believer in Allah - Iraq
Ahmed al-Hasan Response:
In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, Lord of the worlds, and may Allah send prayers upon Muhammad and the family of Muhammad, the Imams and the Mahdis, and grant them peace. If what you took at the time was only to the extent of your need and you used it to meet your need, then nothing is incumbent upon you. The funds are the funds of the Imam and the Muslims. The state of the tyrant owns nothing; rather, its authorities dispose of that which they have no right to dispose of. But if the sum you took was large and exceeded your need, and you still have a surplus from it, whether money or things of considerable value, you must then give what remains of it to the poor. The funds belong to the Imam and the Muslims, so no one is entitled to take possession of them except to the extent that he meets his need with them. Peace, mercy, and blessings of Allah be upon you.
