Question 688

In the name of Allah, the Most Gracious, the Most Merciful. O Allah, send prayers upon Muhammad and the family of Muhammad, the Imams and the Mahdis, and grant them peace. Peace, mercy, and blessings of Allah be upon you, O proof of Allah over His creation and successor of His proof. To proceed: My master, you said in your previous answer-Jurisprudential Answers: Miscellaneous, volume 1, page 19-concerning fish, its ruling, and its lawful taking: ‘If you know that it has scales and are confident that it was lawfully taken, it is permissible to use it for food, because the lawful taking of fish is to take it alive from the water or catch it with fishing equipment, whether the person taking or catching it is Muslim or non-Muslim. This imported fish is caught with nets and fishing equipment, taken out of the water, and usually left to die outside the water, so it is lawfully taken even if the fisher is not Muslim.’ My question: Can confidence be established on the basis of the seller’s statement-whether the seller is Christian or a disbeliever-that the fish they sell in the markets of Western countries was lawfully taken in the manner you mentioned, my master, in your foregoing answer? What if we ask that seller and he answers that he is ignorant and does not know the manner in which the fish was caught? Is it then permissible to purchase and eat the fish he sells? My master, by the right of Zaynab (a), her affliction, al-Husayn’s (a) estrangement and thirst, supplicate for me that I may be a hand for you and a stone in your right hand; that my life end with goodness and a good outcome; and that He, Glorious and Exalted, resurrect me with you, O Household of infallibility and the message-my Lord’s prayers and peace be upon you. Muhammad - North America

Ahmed al-Hasan Response:

In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, Lord of the worlds, and may Allah send prayers upon Muhammad and the family of Muhammad, the Imams and the Mahdis, and grant them peace. It is permissible to rely upon the seller’s statement if you are confident that he is truthful in what he says. But if the seller is ignorant, you must seek another path to learn the condition of the fish he offers. If you can attain confidence that it was lawfully taken, you may eat it.
