Question 29
In my official job I used to travel frequently, covering the legal travel distance more than four days each week. My schedule later changed to shifts. Under my employer's official schedule I still cover the legal distance more than four days a week, but my work includes many days off, so I treated myself as a frequent traveler. What is the ruling on the days when I acted on the assumption that I was a frequent traveler, and what is the ruling on fasting in Ramadan while working?
Ahmed al-Hasan Response:
I have explained the issue of the frequent traveler in detail, so you can refer to it and determine whether you are a frequent traveler and then act according to your duty. I quote here a passage from Al-Shara'i to make it easier to apply to your situation: [The fifth condition is that his travel not be more frequent than his residence, such as the Bedouin who seeks rainfall, the hired carrier, the sailor, the merchant who travels to markets, and the courier. The criterion is this: anyone whose travel is four days per week, sixteen days per month, or six months and one day per year on an ongoing basis performs the prayer in full and fasts while traveling. He begins performing the prayer in full and fasting as soon as he knows that this is his condition, even from the first day of his travel.] As for what you did previously on the basis of your understanding that you were a frequent traveler, it is valid. You do not repeat your prayers or fasts even if you then regarded yourself as a frequent traveler and later discovered that your calculation of your situation had been mistaken.
