Question 20

In what circumstances is backbiting permitted, or in what circumstances is a concession given for it? Is backbiting forbidden only with respect to believers, or does it also include those who oppose the true creed? Which opponents may be backbitten? Does this include those who are excused or negligent in recognizing the truth? What about obstinate opponents?

Ahmed al-Hasan Response:

Forbidden backbiting is mentioning a believer's concealed fault in the believer's absence. There is no backbiting, in the technical ruling, with respect to someone who does not believe in the truth. Nevertheless, the proper character of a believer is to avoid delving into people's concealed faults even if the believer comes to know them. A believer's concealed fault may not be mentioned before people even in the believer's presence. If someone mentions it, he has deliberately humiliated the believer, and this too is a forbidden act like backbiting.
