Question 50

You previously answered concerning fish and their lawful taking: if I know a fish has scales and am reasonably assured that it was lawfully taken, it may be eaten, because lawful taking of fish consists of taking it alive from the water or catching it with fishing equipment, whether the fisherman is Muslim or non-Muslim. Imported fish are usually caught by nets or fishing equipment, removed from the water and left to die outside it, so they are lawfully taken even if the fisherman is non-Muslim. My question is: may reasonable assurance be based on the statement of a Christian or non-Muslim seller that the fish sold in Western markets was caught in the manner you described? What if the seller says he does not know how it was caught—may we then buy and eat the fish he sells?

You may rely on the seller's statement if you are reasonably assured that he is truthful. If the seller does not know, you must seek another way to learn the condition of the fish. If you can reach reasonable assurance that it was lawfully taken, you may eat it.
