Question 77
An Ansari woman has long been married to a non-Ansari man and they have children. After a severe dispute she sued him, and a civil judge ruled that she was divorced, although the husband himself did not pronounce a divorce. Is she legally divorced in Sharia and free to marry another after the waiting period, or does she remain married until he divorces her? If he refuses and causes her harm, what is the way for her to obtain a valid Sharia divorce?
Ahmed al-Hasan Response:
She should submit a request to the Sharia court seeking a Sharia divorce and explain her situation, including that she is already divorced in the official government records.
