Question 143
A woman wants a divorce from her husband, who has been sentenced to life imprisonment and whose sentence has been confirmed by the appellate court. He refuses to divorce her, citing their children. She says that even if he is released she will not return to him. What should be done?
Ahmed al-Hasan Response:
If the question is whether the husband is obliged to divorce her, the answer is that he is not obliged to do so. If the question concerns her situation and what she should do, it is better for her to wait and consider the matter more carefully. In any event, if she insists on divorce and the husband refuses, she must take the matter to a religious judge for consideration. There is a religious court of the supporters of Imam al-Mahdi in Najaf, and she can present her case to them; God willing, that will be better.
