Question 124

Can some rules of religious law relating to personal status change in certain situations as social and economic circumstances change over time? I understood that a man has more rights than a woman because he has more responsibilities and duties. But what if the man fails to fulfill those responsibilities—do those rights remain or fall away? For example, if a husband does not provide for his family, does not care for his children, and has no meaningful or financial presence in their lives, so that support and upbringing fall entirely upon the woman, does such a husband still retain rights such as obedience and qiwama? Unfortunately, in Arab and Muslim societies there are many families supported by women alone because of the husband's failure or absence, or jointly with husbands because of severe economic circumstances and the domination of tyrants. How does this affect the equation that the husband has more rights because he is the responsible provider?

Changing legal rulings belongs to God's caliph in every age. Rulings can change and can be abrogated; I have mentioned this previously.
