Question 125

God says: ‘If a woman fears ill-conduct or aversion from her husband, there is no blame upon them if they make terms of settlement between them, and settlement is best...’ (Quran 4:128). What precisely constitutes a husband's nushuz? Is there a legal punishment for a husband who is in nushuz? What is the ruling on a husband who neglects his home, wife and children?

Ahmed al-Hasan Response:

I mentioned the husband's nushuz in Al-Shara'i. It consists of denying the wife her rights or some of her rights, and she may bring a legal claim against him.
