Question 126

When the issue of striking a wife in a state of nushuz is discussed religiously, everyone agrees that it must not be a severe beating. But in lived reality severe beatings and bodily harm to wives often occur. What exactly are the limits of striking a wife in nushuz, and what is the punishment for a husband who exceeds them? Would patience, good treatment and reforming character not be more appropriate than physical harm that produces humiliation, especially when directed at someone weaker who is under one's protection and care?

Ahmed al-Hasan Response:

Striking one's wife is not a normal situation or the course that should ordinarily be followed. In the divine state, if a wife brings a complaint that her husband struck her, the matter is investigated, and if the husband is found guilty he is punished.
