Question 91
A husband and wife had no children, so a doctor took sperm from the husband and fertilized the wife's egg. The doctor told them that enough sperm had been preserved in a solution to remain usable for many years, so whenever they wanted another child it could be implanted in the wife without taking another sample. If the husband later dies and, years afterward, the widow wants a child with the approval of her family, may the doctor implant sperm preserved from her deceased husband? What is the ruling on the child and to whom is the child attributed?
Ahmed al-Hasan Response:
It is permissible if she has not married after her husband's death—that is, if she is not married to another man. The child is attributed to the deceased husband.
