Question 334
1. A believing person called the adhan and iqamah and entered prayer. During prayer, something issued from him that invalidates prayer. Must he call the adhan and iqamah after performing ablution, given that he will change his location by going to perform ablution? 2. A believing person observes an obligatory fast on days when fasting is recommended, such as three days of each month and the days of Dhu al-Hijjah. Does he receive the reward of the recommended fast on these days? 3. I owe several months of fasting, several years of prayer performed by proxy for which payment was received, and two complete recitations of the Quran that were not finished, for all of which payment was received. Likewise, my daughters used to fast and pray for hire, and [corrupt wording in the Arabic source], with some remaining due from them until now. A believing woman likewise fasts and prays by proxy for hire and still has some outstanding, for the sake of living with dignity away from the vile ones who seized your thrones, removed you from the ranks in which Allah placed you, made your unlawful lawful, and made your lawful unlawful. My master, O son of the bestowed mercy and extended blessing, O son of Mecca and Mina, O son of Ta-Ha and the unequivocal verses: command me with your command, teach me from your knowledge, take my hand to leave every forbidden thing, and aid me in entering every lawful thing. What is the ruling concerning the past performance of this work and the money received in return for it? Know, my master-and you know better-that to the best of my knowledge, those who gave these to me, namely the intermediaries, do not believe in you and what you brought, and likewise the deceased on whose behalf the acts were performed; Allah knows best. 4. I performed the pilgrimage to Allah’s Sacred House three times. The first time was the obligatory pilgrimage. After entering consecration for the Umrah of tamattu, my wife, daughters, and I rode in the car of one opposed to Allah’s religion, and I traveled under shade. What is the ruling concerning this? The third pilgrimage was performed by proxy for payment. What is the ruling concerning performing pilgrimage by proxy? I also traveled under shade after the Umrah of tamattu; what is the ruling concerning that? During the second pilgrimage, I performed five individual Umrahs from the nearest point outside the Sanctuary voluntarily on behalf of others, and in all of them I traveled under shade after entering consecration. What is the ruling concerning that? 5. Al-Mufaddal ibn Umar narrated from your grandfather Imam al-Sadiq (a): ‘Temporary marriage has seventy conditions …’ Would you explain them, including which is an essential element of the contract, which is obligatory, and which is recommended-that is, which condition, if absent, invalidates the contract and makes it fornication? 6. A man concluded a temporary marriage contract with a woman for two years, with no third person present because of circumstances specific to the woman: fear of her family and especially her children; and likewise the man, out of concern for his family and separation from them. What is the ruling concerning that? Sender: Muhammad
Ahmed al-Hasan Response:
In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, Lord of the worlds. A1: He does not repeat the adhan and iqamah. The one who repeats the adhan and iqamah is one who leaves the place of his prostration, turning away from the prayer toward another act. This believer left the place of his prostration only to perform ablution for prayer, so he did not turn away from the prayer toward another act. A2: Allah willing, yes. A3: Receiving payment for reciting the Quran aloud is permissible, even if no human being attends it, for believing jinn whom you do not see attend it. A: There is nothing upon you for the fasting and prayer you performed in the past in return for payment if you did not know it was an innovation not instituted in the Quran or the practice of the Prophet (s) and his household (a). A: As for the payment you received for fasting and prayer on behalf of deceased people-those who died holding allegiance to the Proof of Allah in their time, or whose condition you do not know-but did not perform: I ask you, your wife, your daughters, and the believing woman to enumerate it. Allah willing, your believing brothers will give the amount in charity when they receive the number from you. I have informed them, and they are awaiting your answer. You may also make up prayer and fasting for deceased people from whom you previously received payment to make them up-if you did not know that prayer and fasting in return for payment was an innovation-but now you intend to make them up as an act of drawing near to Allah, not for the payment you previously received. Regarding making up prayer, making it up on the twenty-third night of Ramadan is equivalent to a thousand months. If, for example, a person owes a year, ten years, or even a thousand months of prayer, it suffices him to make up one day on Laylat al-Qadr. A4: Performing pilgrimage by proxy for payment is permissible. There is nothing upon you for traveling under shade while consecrated before you believed in the truth. I have come to demolish the structure of falsehood and build the structure of truth through Allah’s power, strength, and will, and through your aiding and bearing the truth, Allah willing. I did not come to charge you with that for which you have no capacity. The law of our father and your purest father Abraham (a) is the tolerant law and Allah’s innate nature brought by the Messenger of Allah Muhammad (s): ‘Allah does not burden a soul beyond its capacity. It shall have what it earned and bear what it acquired. Our Lord, do not take us to account if we forget or err. Our Lord, do not place upon us a burden like that which You placed upon those before us. Our Lord, do not burden us with what we have no strength to bear. Pardon us, forgive us, and have mercy upon us. You are our Guardian, so support us against the disbelieving people’ ([86]). A5: Both permanent and temporary marriage require: 1. Witnessing or publicizing-announcement. Witnessing is by two just witnesses. Publicizing and announcement occur after concluding the contract and before consummation, and are realized by what is customarily called publicizing and announcement, such as an invitation to a wedding feast or the like. 2. The shortest duration of temporary marriage is six months. Allah willing, you will find further detail in the completed book The Laws of Islam, which the believers will publish soon, Allah willing. A6: In the situation you mentioned, publicizing-announcement-may be difficult, but witnessing is not difficult. He should renew the contract with her in the presence of witnesses and instruct the two witnesses to keep the matter secret except in cases of necessity or to establish rights. Ahmed Alhasan
