Question 435

In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, Lord of the worlds, and may Allah send prayers upon Muhammad and the family of Muhammad, the Imams and the Mahdis, and grant them abundant peace. I ask forgiveness and pardon from my guardian, Allah’s Proof over me and His creation, Imam Ahmed Alhasan (a), and I apologize to you, my guardian, for the length of this message. Briefly, my guardian, I know a woman in the country where I reside. She is divorced, has good character, and lives alone, away from her family, in this corrupt Western country. I have known her for a long time and met her today while she complained of the life she lives amid predatory beasts. I felt compassion for her condition and for that of many women from my country who reside here. I sensed from her words that she wanted to marry a mindful person. She knows only that my belief is Shia, and she is divorced. She asked me to marry her so that I might protect and shelter her, although she is slightly older than I am. I told her that if I married a second time, I would marry only a believing woman. She said that she needs a believer so that she may return to Allah. I have not presented the Call to her because she is illiterate and knows nothing. I told her that if Allah decreed that I marry her and she did not believe and adhere, everything would end. She agreed, saying she wanted to return to Allah, was tired of this filthy life, and wanted to purify herself. She also knows that I am married and have children. I told her that I would seek Allah’s counsel and answer her. I sought counsel from Allah, the Exalted, concerning whether this woman was good for my Hereafter and my world, and the result indicated success and happiness. Another matter, my guardian, is that marriage in this country takes place between the spouses in a mosque in the presence of two witnesses, because the mosque belongs to the Sunnis. End. My guardian, I ask for your counsel and direction because you know best. May Allah send prayers upon you, your forefathers, and your good and pure sons. Sender: From Spain

Ahmed al-Hasan Response:

In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, Lord of the worlds, and may Allah send prayers upon Muhammad and the family of Muhammad, the Imams and the Mahdis, and grant them peace. If Allah’s counsel indicated good for you, then good lies in what Allah, Glorious is He, chooses. As for the contract-may Allah grant you success-you yourselves can conclude the contract between you and have two witnesses witness it, or inform a number of people after you conclude the contract. For example, invite some people you know to a meal so that some people know of your marriage. Even if you conclude the contract in the mosque of the opponents for documentation or some other reason, you may repeat the contract formula if it contains some defect. For the contract, it is sufficient for her to say to you, ‘I marry myself to you for a dowry of such-and-such’-and she states the dowry-and for you to say, ‘I accept the marriage.’ There is no need for a third party to prompt the two of you. It is only necessary that two witnesses be present at the time of the contract. If that is not possible, then after the contract publicize the matter by informing a number of people that you married so-and-so. You may publicize it by any method you choose, such as a wedding meal, an announcement, or any form suited to your circumstances. Peace, mercy, and blessings of Allah be upon you. Ahmed Alhasan Late Safar 1431 AH
