Question 544
In the name of Allah, the Most Gracious, the Most Merciful ... Praise be to Allah, and may Allah send prayers upon Muhammad and his good and pure family, the Imams and the Mahdis, and grant them abundant peace. My master Ahmed Alhasan, I have some very pressing questions, for they concern many ongoing transactions of daily life. Q1: My master, we believe that every authority other than one appointed by Allah is a tyrannical authority that one is obligated to reject. But, my master, we urgently need to know the limits of dealing with a tyrannical ruler in various transactions. Examples include obtaining official documents that entail many declarations amounting either to a willingness to accept recourse to courts that judge by other than Allah’s religious law, or to consent to becoming one of the state’s soldiers. It is worth mentioning, my master, that these numerous and varied documents are often a means of securing some benefit. Obtaining an identity card allows you to obtain a passport and a ration card; moreover, if a citizen does not carry it, he will be liable to imprisonment or a financial fine, or at least humiliation. But there are things that constitute benefits whose loss would not lead to what the loss of an identity card leads to. A ration card, for example: losing it will force you to buy provisions at high prices. A telephone contract, for example, can be dispensed with, although a person needs it; it can be replaced by a mobile telephone, but that is more costly. The same applies to an electricity contract. Also, my master, many contracts require the payment of money that ultimately goes to the treasury of the tyrannical ruler. So I ask you, my master and guardian, to bestow your favor upon your ignorant servant and bring us relief with a detailed answer. Q2: What if failure to join the army leads to being prevented from traveling to European or other countries? In order to avoid that, is it possible to join an army that is not expected in the near term to enter a war against any enemy? Indeed, there are branches of the state’s institutions that operate within internal field work. So I ask you, my master, to explain those issues to us in detail. Q3: To my knowledge, land controlled by a tyrannical ruler has the ruling of usurped land. The question is: are the contracts the tyrannical ruler imposes in order for one to obtain some benefit the product of his investment of the money he extracted from the usurped land over which he gained control? Are those contracts genuine contracts to which the rulings governing contracts apply, or are they unfit to be contracts because he is not the owner of the money he invested from the land he usurped? Q4: My master, I was offered work at a student-services center. This center receives anything that students or other people want and types it on a computer, then produces it on paper or another medium. Among the troubling things that one fears being asked to type are, for example, materials discussing Western theories and also the glorification of the ancient pharaohs. Is it possible to work at such a center or not? If it is possible, what are the conditions? I supplicate to Allah by the right of your grandfather Muhammad, by the right of your mother Fatima, and by the right of all your forefathers that He bring you relief, make victory your ally, and make us righteous supporters of you and your father. May Allah’s peace, mercy, and blessings be upon you forever and ever. Sender: Abdullah - Egypt
Ahmed al-Hasan Response:
In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, Lord of the worlds, and may Allah send prayers upon Muhammad and the family of Muhammad, the Imams and the Mahdis, and grant them peace. A to Q1: There is no problem with obtaining documents used to establish certain matters or benefits from the state, even if it is an illegitimate state. There is no problem with benefiting from them, but it is not obligatory to respect the man-made laws that the state enacts. A to Q2: If failure to join causes you harm and injury, there is no problem with your joining the army, provided the army does not directly carry out acts of injustice against people or protect oppressors and facilitate their commission of injustice. A to Q3: As far as a believer is concerned, he may benefit from those contracts, but he is not obligated to respect them or abide by carrying out what they contain. A to Q4: There is no problem with work of this kind, and there is no problem with printing research conducted by students unless the research aims to attack the sanctities of religion and the religious law or to mock them. Peace, mercy, and blessings of Allah be upon you. Ahmed Alhasan Rajab al-Asabb / 1431 AH
