Question 679
My father died more than twenty years ago and left a testament that included the following: his eldest son was to distribute one-third of his estate to those in need and to charitable works. The deceased’s estate consisted of money and a house. The instruction concerning the money was carried out after his death, but the problem now concerns the house, which they now want to sell. The eldest son sees that some of the children need money, since their circumstances are straitened. The question is: May I dispose of the one-third designated by the testament for those in need by giving part of it to charitable works and distributing the remainder among the deceased’s children? A question submitted through your servant, Abu Sarah - Kuwait
Ahmed al-Hasan Response:
In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, Lord of the worlds, and may Allah send prayers upon Muhammad and the family of Muhammad, the Imams and the Mahdis, and grant them peace. It is permissible.
