Question 680

Peace, mercy, and blessings of Allah be upon you. The following text appears in volume three of The Laws of Islam: ‘… If she became pregnant through fornication, then her husband divorced her, she observes the waiting period in months, not until delivery. If intercourse occurred by mistake and the child was attributed to the one who had intercourse because the husband had been away from her, and then the husband divorced her, she observes a waiting period until delivery for the one who had intercourse, and then begins the divorce waiting period anew after delivery …’ Does a woman who became pregnant through fornication and had no husband have a particular waiting period? Is it permissible to marry her during her pregnancy, whether by the man who committed fornication with her or by another? Ahmed - Iraq

Ahmed al-Hasan Response:

In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, Lord of the worlds, and may Allah send prayers upon Muhammad and the family of Muhammad, the Imams and the Mahdis, and grant them peace. She has no waiting period. It is permissible for her to marry during her pregnancy the man who committed fornication with her, and it is disliked for her to marry someone else.
