Question 70
A person owed me money from a business partnership that he mishandled. Because of his difficult circumstances, I released him from liability. He is now financially well-off. May I ask him for my right after having released him from liability?
Ahmed al-Hasan Response:
If you released him from liability absolutely—meaning that you gave him the debt as charity—then it is not permissible to take back charity after it has been given, so you may not demand it from him. But if you released him from liability specifically because of his weak financial condition, then if he died while still in that condition his liability would be cleared and the debt would lapse; if his financial condition later improves, he is to return your money. In that case, you may demand it from him.
