Question 165
Some people sometimes prevent the government or a contractor from carrying out projects such as schools by claiming that the land belongs to them, and sometimes take money from the contractor to allow the work to proceed. Is this conduct legitimate?
Ahmed al-Hasan Response:
If the land is not actually his, then this conduct is unlawful and the money he obtains is illicit. However, if a community lives in a certain area and an outsider, a company, or a government other than the government of the just Imam wants to establish a public or private project there, the people of that area may object to or stop the project, or demand compensation for harm they reasonably expect from it. For example, if such a government or company wants to drill an oil well, open a quarry or mine, build a factory or bridge in their area, and they reasonably expect environmental pollution, loss of a road, congestion, harmful noise, displacement of wildlife, or another logical harm, they have the right to object, prevent it, or demand compensation for the harm that will affect them or their area.
