Question 164

Is it permissible to take financial compensation from members of the Ba'ath Party or agents of the former regime because their reports against people caused executions, imprisonment, displacement, destruction or burning of homes? What amount should be taken? Is the harm established by a written report from a security officer or party member, and is one witness sufficient if there is no report?

Ahmed al-Hasan Response:

Anyone who has suffered or suffers financial, psychological or family harm because of another person or group may demand appropriate compensation, financial or otherwise, within the limits of religious law. As for establishing that the harm occurred, that is determined by the body before which the dispute is brought, whether tribal or governmental. Our answer does not determine that matter because we are not governing or supervising a state in which rights are adjudicated for such a question to be directed to us.
