Question 170

Our tribe sometimes receives a tribal compensation payment. May we take from it, given that we also contribute when such compensation is imposed on our tribe? Is paying into it permissible?

Ahmed al-Hasan Response:

If the payment is compensation for an individual member of the tribe, such as blood money or something similar, it belongs to that person and others may not share in it. If it is compensation for all members of the tribe, such as compensation for tribal communal land or something similar, it may be distributed among the tribe's members and each person may take his share. Contributing money to help a member of the tribe pay a compensation obligation imposed on him is permissible and is an act of kindness, especially if he cannot afford the amount or if paying it would cause him serious harm.
