Question 71
It is commonly said among Sunnis, and perhaps among followers of the religious authorities as well, that a passerby may eat enough fruit or vegetables from an unfenced orchard to satisfy his need without the owner's permission. What is the legal ruling on this?
Ahmed al-Hasan Response:
A passerby may eat so long as the farm or orchard is not fenced.
