Question 192
My father died more than twenty years ago and left a will stating, among other things, that one third of his estate was to be distributed by the eldest son to the needy and to charitable works. His estate consisted of money and a house. The instruction was carried out regarding the money after his death, but the issue now is the house, which they want to sell. The eldest son sees that some of the deceased's children are themselves in need because they live with limited means. May I use the one-third share designated in the will for the needy by giving part to charitable works and distributing the rest among the deceased's children?
Ahmed al-Hasan Response:
It is permissible.
