Question 132
Al-Shara'i, volume 3, states: ‘If she becomes pregnant through zina and then her husband divorces her, she observes the waiting period by months, not by childbirth. If she was intercourse with under mistaken circumstances and the child is attributed to the man who had intercourse with her because the husband was absent, then the husband divorces her, she first observes the waiting period until childbirth for the man who had intercourse with her, then begins the divorce waiting period after delivery.’ If a woman becomes pregnant through zina and has no husband, does she have a specific waiting period? May she marry during pregnancy, whether the man with whom she committed zina or another man?
Ahmed al-Hasan Response:
She has no waiting period. She may marry during pregnancy the man with whom she committed zina. Marriage to another man during the pregnancy is disliked.
