Question 148
A person has a house built from his salary and the salaries of his four sons. His salary was 600 dollars and each son's salary was 150 dollars, although one son spent more than his brothers. How should the house—and likewise the land bought from the same source—be divided? Does the father have the right to withhold from one son out of the father's own share, given that the father owns half the house and one son is demanding his share?
Ahmed al-Hasan Response:
The son who contributed less money has a share corresponding to what he contributed, and each of the others, including the father, has a share corresponding to what he contributed. The father, like any other person, may dispose of his own property during his lifetime and give it to whichever of his children or other people he wishes, so long as he is not suffering from an illness of death or another serious illness from which death is feared.
