Question 175
I want to ask about the religious ruling on two real-estate arrangements. First, what is called a 'rahina': the tenant lends the homeowner a certain sum of money, and in return the owner rents the house to him for a rent much lower than the normal market rent; when the rental period ends, the owner returns the amount originally lent. Is this permissible? Second, what is called 'sarout': an old tenant—whose rent is very low compared with normal rent because the tenancy began long ago—sells his tenancy right to a new tenant, usually for about one fifth of the property's value, either with or without informing the owner, while the tenancy remains open-ended at the old rent. What is the ruling?

The first arrangement is permissible. As for the second, if the old tenant originally paid the owner a specific amount in exchange for entering into a lease at a fixed rent that would not change, then he has a right that he may sell. But if he is merely an old tenant, he has no such right.
