Question 81
A brother donated money to me so that I could give it to those who deserve it. I am unemployed, as is my brother, and no one meets our needs. Sometimes we need assistance but find it difficult to say that we are in need. May I take a certain amount from this money and spend the rest in God's cause, such as helping another believing brother, in accordance with the donor's intention?
Ahmed al-Hasan Response:
If the donor gave you the money to spend for a specified purpose, you must adhere to the purpose he specified. If he wanted it delivered to the Bayt al-Mal, it must be delivered there. If he wanted you to distribute it among orphans, you must do that. If he wanted you to distribute it among the poor, then distribute it among the poor. If you yourselves are poor and in need of the money, you may take a share just like the others among whom you distribute it.
