Question 162

A heart patient was driving when another person hit his car. The traffic diagram assigned fault to the heart patient, and three days later he died. The families had agreed to refer the matter to Sharia, but the deceased's family later demanded a tribal settlement or blood money. What are they entitled to, how much weight does the traffic report carry, and does a negligent party have a right to blood money?

Ahmed al-Hasan Response:

If it is established that the other party was negligent and that the death resulted from the accident, it is considered accidental killing and entails blood money or a mutually agreed settlement between the parties. A traffic diagram may be treated as an indication in such a matter, no more; it cannot be relied upon one hundred percent, and other indications or evidence must be available. If the deceased was one hundred percent at fault, it is not considered accidental killing and no blood money is paid. In all cases, reconciliation and mutual agreement are preferable to dispute, especially when a death has occurred.
