Question 167
A believing woman with four children was severely abused by her nonbelieving husband and eventually set herself on fire after escalating physical and verbal abuse and isolation. Before her death she described the abuse in the hospital and it was recorded by an investigating official. May the husband be imprisoned if his actions drove her to suicide, and may her family take a tribal settlement of roughly 20 to 30 million?
Ahmed al-Hasan Response:
The husband may be imprisoned and punished if he caused harm to his wife in a way that drove her to kill herself. A tribal settlement may also be taken as blood money for the woman if it is established that the husband drove her to kill herself. As for waiving the complaint and accepting a tribal settlement, that belongs to the woman's family. If they decide to waive the complaint, it is preferable that they first secure their rights.
